Plain-English summary: PitchSmart is a B2B sales tool. We collect data about you (our user) and about the business prospects you research. 1. Who This Policy Applies To

This Privacy Policy describes how PITCHSMART SOFTWARE INC. ("PitchSmart," "we," "us," or "our") collects, uses, and shares information when you use our platform at pitchsmart.com.

PitchSmart is a business-to-business (B2B) platform intended for professional use by adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us at contact@pitchsmart.com and we will delete it promptly.

2. Information We Collect

A. Information You Give Us Directly

  • Account information: Your name, email address, company name, job title, and password when you register.
  • Product and sales intelligence data: Information you enter into PitchSmart during onboarding, such as your product description, target customers, competitors, and sales methodology inputs.
  • Prospect and contact data: Names, job titles, company names, and professional contact information of the prospects you research within the platform.
  • Communications: Messages you send us by email or through support channels.
  • Payment information: Billing details processed by our payment provider. We do not store full card numbers on our servers.

B. Information We Collect Automatically

  • Usage data: Pages visited, features used, search queries made within the platform, time spent, and actions taken.
  • Device and log data: IP address, browser type, operating system, referring URLs, and timestamps.
  • Cookies and similar technologies: See Section 9 below.

C. Information from Third-Party Data Sources

To power its research and signal features, PitchSmart uses third-party data providers and AI services to retrieve publicly available business information about the companies and professionals you research. This may include:

  • Company news, funding announcements, and hiring signals (via web search and news APIs);
  • Company technology stack and software usage data;
  • Professional profile information and company updates from professional networking platforms, accessed via authorized third-party API providers;
  • AI-synthesized research summaries generated using large language model services, including the Anthropic Claude API.

PitchSmart does not directly access LinkedIn or any other professional platform. Research data is retrieved through third-party API services that operate under their own terms and applicable law.

We do not sell your personal information to third parties for their own marketing or commercial purposes.

Controller and Processor Roles for Prospect Data. When you use PitchSmart to research, enrich, or store information about third-party individuals — such as business prospects, leads, or contacts — you are the Data Controller for that personal data, meaning you determine the purposes and means of its processing. PitchSmart acts as your Data Processor, processing that data only on your instructions and as necessary to deliver the service. As Data Controller, you are solely responsible for ensuring you have a lawful basis to collect and use that prospect data under applicable privacy law. Where a formal data processing arrangement is required (for example, under the GDPR or BC PIPA), this relationship is governed by PitchSmart's Data Processing Agreement (DPA), referenced in our Terms of Service and available upon request at contact@pitchsmart.com.

4. How We Share Your Information

We share your information only in the following circumstances:

  • Service providers: We share data with vendors who help us operate PitchSmart, including cloud hosting providers, payment processors, email delivery services, analytics tools, and AI API providers (including Anthropic). These providers are contractually required to protect your data and use it only for the purposes we specify.
  • Third-party data and AI APIs: When you research a prospect, we send queries to third-party research and AI services. These queries may include company names, prospect names, and job titles. Please review the privacy policies of these providers for more information.
  • Business transfers: If PitchSmart is acquired, merged, or sold, your data may be transferred as part of that transaction. We will notify you before your data is transferred and becomes subject to a different privacy policy.
  • Legal compliance: We may disclose your information if required by law, court order, or government authority, or if we believe disclosure is necessary to protect the safety, rights, or property of PitchSmart, our users, or the public.
  • With your consent: We may share your information with third parties when you have given us explicit permission to do so.

5. Data Retention

We retain your account data for as long as your account is active. If you close your account, we will delete or anonymize your personal data within 90 days, unless we are required by law to retain it longer (for example, for tax or audit purposes).

Prospect research data generated within the platform is retained for the duration of your subscription and deleted within 90 days of account closure.

Anonymized, aggregated usage data may be retained indefinitely for platform improvement purposes.

6. Your Privacy Rights

Depending on where you are located, you have the following rights regarding your personal information:

We will not discriminate against you for exercising your privacy rights.

California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know what categories of personal information we collect and the right to opt out of the "sale" or "sharing" of your personal information. European Economic Area, UK, and Switzerland (GDPR)

If you are located in the EEA, UK, or Switzerland, you have rights under the General Data Protection Regulation (GDPR), including the rights listed above plus the right to object to processing based on legitimate interest. Our legal bases for processing are described in Section 3. If you believe we have not handled your data lawfully, you have the right to lodge a complaint with your local supervisory authority.

British Columbia and Canada (PIPEDA / BC PIPA)

We collect, use, and disclose personal information in accordance with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and British Columbia's Personal Information Protection Act (PIPA). You have the right to access and correct your personal information held by us. To make a request, contact our Privacy Officer at contact@pitchsmart.com.

7. International Data Transfers

PitchSmart operates from British Columbia, Canada. Our service providers — including cloud hosting and AI API providers — may process your data in other countries, including the United States. By using PitchSmart, you consent to your data being transferred to and processed in countries outside your own, which may have different data protection laws.

Where required, we implement appropriate safeguards such as data processing agreements to protect your information during international transfers.

8. Security

We take reasonable technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, and destruction. These include encryption in transit (TLS), encryption at rest, access controls, and regular security reviews.

No system is 100% secure. In the event of a data breach that poses a significant risk of harm to you, we will notify you and any applicable regulatory authorities as required by law.

9. Cookies

PitchSmart uses cookies and similar technologies to operate the platform, remember your preferences, and analyze usage. We use:

  • Essential cookies: Required for the platform to function (authentication sessions, security). You cannot opt out of these.
  • Analytics cookies: Used to understand how the platform is used so we can improve it. You may opt out of these via your browser settings or a cookie consent tool on our site.
  • Marketing cookies: We may use these to measure the effectiveness of our marketing. You can opt out of marketing cookies at any time.

You can control cookies through your browser settings. Disabling certain cookies may affect platform functionality.

10. Third-Party Links and Services

PitchSmart may contain links to third-party websites or integrate with third-party services. This Privacy Policy does not apply to those services. We encourage you to review the privacy policies of any third-party services you use in connection with PitchSmart.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email or through a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of PitchSmart after that date constitutes your acceptance of the updated policy.

The "effective date" at the top of this page reflects when the current version took effect.
